JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Raghunathpur P.S. Case No. 191 of 2017 registered for the offence punishable under sections 272, 273, 308 of the Indian Penal Code and sections 30/38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case at the instance of his enemies. Nothing has been recovered from the conscious possession of this petitioner. As a matter of fact, petitioner has no concern with the alleged foreign liquor. Petitioner is a man of fair antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.9564 of 2018(2) dt.20-02-2018 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge, 2nd -cum- Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Ccase No. 191 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
