The petitioner seeks bail in Karakat P.S. case No. 180 of 2016 under Section 379 of the Indian Penal Code. Later on Section 411 of the IPC was added.

The informant lodged the case against unknown for theft of his motor cycle. During the course of investigation, one Monu Khan is said to have confessed his guilt and in pursuance thereof stolen motor cycle was recovered from the possession of Vikash Kumar.

It is submitted that stolen motor cycle was recovered in front of the garage of Sohail Kureishi and not from the possession of the petitioner. Petitioner is said to be only associate of co-accused and he is in custody since 30.12.2016 and he has got

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bikramganj at Rohtas in Karakat P.S. Case No. 180 of 2016.
