JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-03-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 420, 406, 409 and 120B of the Indian Penal Code.

The allegation against the petitioner is that he and other accused persons had fraudulently got invested more than Rs.45 lacs from complainant and other witnesses with false promise of doubling the amount in a few years and failed to pay back money; the cheque issued by the accused persons have allegedly bounced.

Patna High Court CR. MISC. No.71166 of 2022(2) dt.14-03-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is no specific overt act against the petitioner. He submits that the petitioner himself became victim as he has also invested Rs.24,55,000/- at the instance of coaccused Bishal Gope. He submits that there was no transaction of a single farthing in between the petitioner or the prosecution party. He further submits that all the transactions are between the family members of the complainant and Bishal Gope.

Petitioner has no criminal antecedent, as also mentioned in para3 of the bail application. Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
