The petitioner seeks bail in Jakkanpur P.S. Case No. 123 of 2016, registered for the offences punishable under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR. The informant alleged that his laptop, watch, Samsung mobile and cash of Rs. 2000/- were robbed by unknown persons. The name of the petitioner figured in the case in the confessional statement of co-accused. Thereafter, the petitioner was also arrested and he is also said to have confessed his guilt before the police, but save and except confession of the petitioner there is no material to show the involvement of the petitioner. The petitioner is in jail since
Patna High Court Cr.Misc. No.12556 of 2017 (3) dt.11-04-2017 2/2 22.08.2016, but he has not been put on test identification parade. Learned APP submits that looted motorcycle was recovered in pursuance of the confession of the co-accused and the petitioner, but it appears that in this case the motorcycle was not looted.
Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Patna in Jakkanpur P.S.
