JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioner, learned counsel for the informant and also learned APP representing the State.

The petitioner apprehends his arrest in connection with Rafiganj P.S. Case No. 04 of 2017, registered for the offences punishable under Sections 420, 406, 504, 506 of the Indian Penal Code.

On behalf of the petitioner, it is submitted that the petitioner is ready to deposit the amount of bounced cheque i.e. Rs. 1,40,000/- and Rs. 2,40,000/- total Rs. 3,80,000/- to the informant through bank draft with condition that the said payment will be subject to the result of this case. The learned counsel for the informant is ready to accept the bank draft.

No.11412 of 2017 (2) dt.24-03-2017 2/2 In the facts and circumstances as stated above, two months time is granted to the petitioner to deposit the amount of Rs. 3,80,000/- through bank draft in the name of the informant and the informant will be responsible for the said amount subject to the result of the case and in case the petitioner is not found guilty then the informant will return the said amount to the petitioner accordingly, the petitioner in case of his arrest or surrender shall be released on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S. Case No. 04 of 2017 and after deposit of the amount of Rs. 3,80,000/- through bank draft in the name of the informant the Court below shall confirm the bail bond of the petitioner and in case of failure the bail granted to the petitioner shall be deemed to be cancelled.
