Petitioner seeks pre-arrest bail in Pakribarawan (Dhamaul) P.S.Case No.206 of 2011 registered under Section 366(A) of the I.P.C.

Allegation against the petitioner is of kidnapping of the daughter of the informant.

Learned counsel for the petitioner submits that she was major and her age has been assessed in between 16 to 17 years and further submission is that the victim girl in her statement recorded under section 164 Cr.P.C. has not supported the prosecution case. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, prayer for anticipatory bail of the petitioner is

Patna High Court Cr.Misc. No.12860 of 2018 (2) dt.03-04-2018 2/2 allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Sri Kumar Avinash, J.M. 1st Class, Nawada, in Pakribarawan (Dhamaul) P.S. Case No.206 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and he will cooperate in the investigation and his bailors must be of local having sufficient immovable properties within the jurisdiction of the court.
