Petitioner is in custody since 29.09.2016 in connection with Saraiya P.S. Case No. 134 of 2012 registered under Sections 302, 34 and 120B of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. The main allegation of shot fire on the forehead of the deceased is attributed to co-accused Santosh Singh. The petitioner is rotting in custody for the last five months.

Considering the nature of accusation, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.12267 of 2017 (2) dt.30-03-2017 bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Saraiya P.S. Case No. 134 of 2012.
