JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 25.04.2016 passed in Cri. Misc. No. 5806 of 2016, on the ground that the petitioner is suffering in custody since 25.08.2015 and during postmortem report only two fire arm injuries have been found on the person of the deceased and the informant appears not an eye-witness as death was caused during night as the deceased was wearing only Baniyan and Janghiya.
Learned APP submits that the petitioner is also one of the assailant and informant being an eye-witness has seen the occurrence.
Patna High Court Cr.Misc. No.11259 of 2017 (2) dt.15-03-2017 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and to conclude the same preferably within six months from the date of receipt/production of a copy of this order.
