JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-03-2017 The petitioner is apprehending his arrest in connection with Barari P.S. Case No. 213 of 2016, registered for offences punishable under Sections 302, 201, 120B and 34 Indian Penal Code.

It has been submitted on behalf of the petitioner that save and except suspicion that the deceased girl was coming along with this petitioner, there is nothing against the petitioner so as to connect him with the present case. Further the mobile which has been recovered does not belong to the petitioner and he has been falsely implicated in this case.

Heard learned A.P.P. and learned counsel for the informant, they have opposed the prayer for bail. Learned counsel for the informant has submitted that it has specifically been

Having heard both sides, in view of the fact that there is strong suspicion about the complicity of the petitioner in the alleged offence, as such, I am not inclined to grant the petitioner, the privilege of anticipatory bail, it is accordingly rejected. Let petitioner surrender before the court below and pray for regular bail and if any application is filed the court below shall consider the same on the merit of case, without being prejudiced by the order of this court.
