This application is for grant of bail in connection with Nawada Town P.S.Case No.716 of 2016 for the offence under Sections 307 and 34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the name of the petitioner has transpired during the course of investigation and except that there is nothing against the petitioner. He is in custody since 04.01.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of allegation coupled with criminal antecedent, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after farming of charges in this case in the court below itself, which will be considered by the learned court below

Patna High Court Cr.Misc. No.13763 of 2017 (2) dt.23-03-2017 2/2 on the basis of materials available against the petitioner in this case and will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
