2. The petitioner has prayed for bail in connection with Chapra Muffasil P.S. Case No. 263 of 2023 registered for the offence punishable under Sections 341, 323, 307, 353, 506, 332, 333/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution, in short, is that the petitioner facilitated the accused Jay Prakash Rai to flee away from the custody and it is also alleged that he has assaulted the police personnel.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal

Patna High Court CR. MISC. No.70830 of 2025(2) dt.09-10-2025 2/2 of the F.I.R. it is clear that the nature of allegation is general and omnibus. Altogether four persons are named in this case except the accused Jay Prakash Rai who is alleged to have fled away. It has also been submitted that similarly situated co-accused Sujit Kumar Rai has been granted anticipatory bail by learned Co-ordinate Bench vide order dated 16.10.2023 passed in Cr. Misc. No. 62573 of 2023. It has also been submitted that the case of this petitioner stands on similar footing. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 16.07.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-13, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 263 of 2023.
