JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This is an application for grant of anticipatory bail in connection with Madhuban P. S. Case No. 261 of 2018, disclosing offences under Sections 409, 420, 34 of the Indian Penal Code.

As per F.I.R. petitioner is said to be the Secretary of the Water Management Committee of the Panchayat and work of the water tank has not been done as per the demand, due to which, water tank collapsed.

Submission of the learned counsel for the petitioner is that due to some defects, the water tank fell down and now the same has been restored and she is ready to abide by any condition imposed upon her.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.64602 of 2019(2) dt.16-10-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IV, East Champaran, Motihari, in connection with Madhuban P. S. Case No. 261 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
