Petitioner is apprehending his arrest in Sonebarsa P.S.Case No.192 of 2017 registered for the offences under Sections 364, and 365 of I.P.C.
Allegation against the petitioner is of taking away the husband of the informant and he is still traceless. Submission of the learned counsel for the petitioner is that so called kidnapped person had gone outside for doing job without accompanying with the petitioner four years ago and due to dispute between the parties after a lapse of four years the present case has been lodged.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.3761 of 2018 (2) dt.02-02-2018 2/2 circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in Sonebarsa P.S. Case No.192 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
