It has been submitted on behalf of the petitioner that the trial of the petitioner has been proceeding and till date five witnesses have already been examined.
This Court, therefore, is not inclined to grant bail to the petitioner, at this stage.
The bail petition is disposed of with a direction to the court below to conclude the trial of the petitioner expeditiously preferably within a period of nine months from the date of receipt of this order by giving short adjournments.
The Superintendent of Police, Motihari, East Champaran is directed to produce the witnesses in the case on
Patna High Court Cr.Misc. No.13073 of 2017 (3) dt.11-05-2017 2/2 priority basis so that the trial is concluded within the aforesaid period of nine months.
The petitioner is granted liberty to renew his prayer for bail in the court below itself, in the event the trial is not concluded within nine months, the court below will give reasons for not concluding the trial within the aforesaid period. Let a copy of this order be transmitted/sent to the Superintendent of Police, Motihari, East Champaran, for its strict compliance.
