2. The petitioner seeks bail in connection with S. Tr. No. 585 of 2023 arising out of Vijaipur P.S. Case No. 265 of 2021 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 326, 307, 302 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is not the assailant of the deceased. The assailants are one Bhakoli @ Rajkumar Kharwar and Prem Kharwar. The petitioner is said to have cut hold of the injured, Sintu Pandey.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 24.05.2023 and the co-accused Chand Yadav has already been granted bail by a coordinate Bench of this Court passed by order dated 01.08.2023 in Cr. Misc. No. 46942 of 2023.

5. Learned counsel for the informant submits that

6. Considering the aforesaid facts, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge XIIth, Gopalganj in connection with S. Tr. No. 585 of 2023 arising out of Vijaipur P.S. Case No. 265 of 2021.

8. The petitioner will cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
