The petitioners apprehend their arrest in Katihar Muffasil P.S. Case No.216 of 2017 registered under Sections 379, 323, 506, 341 and 34 of the Indian Penal Code and under Section 37(c) of the Bihar Prohibition and Excise Act, 2016. The informant alleged that four named persons took wine and assaulted the informant when he had gone to see his field.
The learned counsel for the petitioners submits that the petitioners did not take any wine. The petitioners have falsely been implicated in the case on account of some petty dispute for which verbal alteration took place. Two persons namely, Santosh Yadav
Patna High Court Cr.Misc. No.5377 of 2018 (2) dt.07-02-2018 and Dina Singh have already been granted bail. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Court of A.D.J. II-cum-Special Judge, Excise Act, Katihar in connection with Muffasil P.S. Case No.216 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
