Petitioner is apprehending his arrest in connection with Mohania P.S.Case No.568 of 2018 , registered for offences punishable under Sections 406, 420, 34 of the Indian Penal Code.
As per FIR, petitioner has introduced the informant and others to deposit the amount in the Prism Industrial Ltd. Company and on maturity he refused to return the amount and the office was also closed.
Submission of the learned counsel for the petitioner is that there is no allegation that the petitioner is either Director or any office bearer of the company and amount has not been paid to him. Petitioner has also deposited the amount in the
Patna High Court CR. MISC. No.64788 of 2019(3) dt.14-11-2019 2/2 same Company and office bearer has closed the office and fled away, as such the petitioner can not be held responsible rather he is also affected person .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabhua in connection with Mohania P.S.Case No.568 of 2018 dated 20.9.2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
