JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-03-2017 The petitioners are apprehending their arrest in connection with Tikapatti P.S. Case No. 127 of 2014, registered for offences punishable under Sections 420, 406, 467, 468, 323, 452, 379 and 427 Indian Penal Code.

It has been submitted on behalf of the petitioners that petitioners in this case are mother and daughter and allegation against them is that petitioner no. 1, co-sharer of the informant executed the land in favour of her daughter i.e. petitioner no. 2 more than her share in the alleged land, however, in this case I.O. submitted final form but learned Magistrate took cognizance against the petitioners differing with the opinion of the I.O. Learned counsel for the petitioners further submitted that this is

Patna High Court Cr.Misc. No.12624 of 2017 (2) dt.30-03-2017 2/2 out and out a case of civil nature and petitioners are ladies and have no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of offence and also that petitioners are ladies and have no criminal antecedents, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM- VI, Purnea, in connection with Tikapatti P.S. Case No. 127 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
