This application is for grant of bail in connection with East ColonyP.S.Case No.47 of 2016 for the offence under Sections 399 & 402 of the IPC and Section 25 (1-b)a, 26 (i) (ii)/35 of the Arms Act .

It is submitted on behalf of the petitioner that there is allegation of recovery of one country-made Pistol with cartridges but the petitioner is now in custody for about six months. Heard learned A.P.P. also.

Having heard both sides and from perusal of the petitioner, it appears that the petitioner was earlier convicted in a case under Section 27 of the Arms Act and after bail, the present case has been filed.

No.13724 of 2017 (2) dt.23-03-2017 2/2 Considering all aspect of the matter, I am not inclined to grant bail to the petitioner at this stage, however, as the petitioner is in custody, the learned trial court is directed to conduct the trial on day-to-day basis and the S.P., Munger is also directed to ensure presence of the witnesses in the court on the date fixed by the learned court below so that the trial may be concluded within the period as specified by the learned court below. With the aforesaid observation, this application is dismissed.
