JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2017 The learned counsel for the petitioner submits that the petitioner no.1 (Chandeshwar Tiwari) has been arrested and, as such, his pre-arrest bail has become infructous and permission has been sought to withdraw this Criminal Miscellaneous. Permission is granted and this Criminal Miscellaneous against the petitioner 1 (Chandeshwar Tiwari) is dismissed as withdrawn.
After some argument, the learned counsel for the petitioner also seeks permission to withdraw this Criminal Miscellaneous of petitioner no.2 (Sandeep Tiwari) with liberty to surrender in the court below and seek regular bail application. Under the facts and circumstances as stated above, the Criminal Miscellaneous against the petitioner no.2 (Sandeep Tiwari) is also dismissed as withdrawn and petitioner no.2 is
Patna High Court Cr.Misc. No.13584 of 2017 (2) dt.25-04-2017 2/2 directed to surrender within six weeks from the date of receipt/production of a copy of this order in the learned court below and seek regular bail and then his regular bail shall be considered on the same day without being prejudiced by this order.
