JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner, who is in custody since 20.08.2019, seeks bail in connection with Guraru P.S. Case No. 24/11, dated 02.04.2011, instituted for the offence under Sections 406, 409, 467, 468, 471 and 34 of the Indian Penal Code.

The petitioner, at the relevant time was the Mukhiya of Malpa Panchayat who is alleged to have embezzled funds of MANREGA and diverted the same into the account of her husband.

Learned counsel for the petitioner has submitted that the MANREGA work has been completed which presupposes that no money has been diverted to any unauthorized account.

Patna High Court CR. MISC. No.73281 of 2019(4) dt.05-03-2020 2/2 submitted that the husband of the petitioner as well as the Rojgar Sewak of the concerned panchayat, who too have been made accused in this case, have been granted bail by the court below.

Regard being had to the facts of this case as well as the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Gaya in connection with Guraru P.S. Case No. 24/11.

The application stands allowed.
