The petitioner is accused in connection with Adapur P.S. Case No. 115 of 2019 registered under sections 8(c) and 21(b) of the N.D.P.S. Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner is in custody since 08.05.2019. Nothing has been recovered from the possession of the petitioner. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report. There is specific allegation of recovery of 91 grams Morphine against him. Hence, he does not deserve privilege of bail.

Patna High Court CR. MISC. No.68290 of 2019(3) dt.04-12-2019 2/2 Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
