The petitioner seeks bail in Azimabad P.S. case No. 22 of 2003 under Section 386/34 of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner was on bail but his bail bonds were cancelled on 23.12.2015. The petitioner is in jail since 03.12.2016 for misuse of privilege of bail. The petitioner has remained in jail for five months.

Considering the facts that, of course, bail bonds of the petitioner were cancelled on 23.12.2015 and the petitioner was declared absconder on 17.11.2016 but the petitioner is in jail since 03.12.2016 and he has already remained in jail for five months, the above named petitioner is directed to be enlarged on bail on

Patna High Court Cr.Misc. No.12486 of 2017 (3) dt.02-05-2017 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in Azimabad P.S. Case No. 22 of 2003.
