Petitioner apprehends his arrest in connection with Piro P.S.Case No. 258 of 2017 registered for the offences punishable under Sections 147, 148, 149, 120B, 295A, 153A, 188, 353, 307, 323, 341, 504, 379, 436, 427/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner and 500 other accused persons is that they came in unlawful assembly making allegation and also damaging the temple.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and other co-accused persons having similar allegation have been granted privilege of anticipatory bail vide order dated 31.1.2018

Patna High Court Cr.Misc. No.39806 of 2018 (3) dt.16-07-2018 2/2 passed in Cr.Misc.No. 63053 of 2017 by co-ordinate Bench of this Court.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Bhojpur at Ara, in connection with Piro P.S.Case No. 258 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
