This is an application for grant of anticipatory bail in connection with Fatuha P.S. Case No. 121 of 2017 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B), 26 and 35 of the Arms Act. The allegation is regarding the Police having received information that criminals had assembled at Fatuha-Daniyawa main road and were standing to commit loot and when the Police reached there, some of the criminals managed to flee away but on chase, four of them were nabbed and they in their confessional statement took the name of the present petitioner. The learned counsel for the petitioner submits that merely on the basis of the confessional statement, the petitioner has

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna City in connection with Fatuha P.S. Case No. 121 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
