JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-03-2017 The petitioner seeks regular bail in connection with Katihar Town P.S. Case No. 113 of 2017, registered for offences punishable under Section 30(A) of Bihar Excise Act. It has been submitted on behalf of the petitioner that allegation against the petitioner that a bottle containing 750 M.L. of foreign liquor has been recovered from him, however the petitioner has sufficiently been punished for the said offence as he has remained in custody for more than one month. Learned counsel for the state opposed the prayer for bail and submitted that the petitioner was earlier granted bail in December 2016, for the same offence and now he has again committed the said offence.

Having heard both sides, from perusal of the impugned

Patna High Court Cr.Misc. No.13965 of 2017 (2) dt.27-03-2017 2/2 order, it appears that learned Sessions Judge, himself has given the liberty to petitioner to renew his prayer for bail after three months or after framing of charge, whichever is earlier As such, at present, this court is also not inclined to grant the petitioner the privilege of regular bail, it is accordingly rejected.

However, the petitioner, as mentioned in the impugned order also, shall renew his prayer for bail after three months on or after framing of charge.

With the above observation, this application is disposed of.
