2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
3. The petitioner is apprehending his arrest in a case in connection with Uchakagaon P.S. Case No. 497 of 2022 dated 22.12.2022 registered for the offence/s punishable u/ss 147, 148, 149, 323, 307, 354, 379, 188, 504 of the Indian Penal Code.
4. As per the prosecution case, the petitioner and the co-accused persons were sitting at the ancestral land of the informant. When the informant protested by stating that section 144 of the Cr.P.C. is in force, then the co-accused assaulted her
Patna High Court CR. MISC. No.72965 of 2023(2) dt.08-11-2023 2/3 with iron rod and both the accused tried to outrage her modesty. When the informant's mother-in-law came to rescue, then they also assaulted her. Further, they snatched the informant's Mangalsutra and threatened to kill them.
5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. There is case and counter case between the parties. Learned counsel has further submitted that both the parties are Patidar. There is no specific allegation of assault against the petitioner. Learned counsel has further submitted that the petitioner is simply order giver. The petitioner is also accused in two other criminal cases and he is on bail in all the said criminal cases as stated at para 3 of the bail petition.
6. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gopalganj in connection with Uchakagaon P.S. Case No. 497 of 2022, subject
Patna High Court CR. MISC. No.72965 of 2023(2) dt.08-11-2023 3/3 to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
8. The application stands allowed.
