2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 379, 414, 420, 467 of the Indian Penal Code and under Prevention of Animal Cruelty Act, 1960.
3. As per prosecution case, container vehicle bearing registration No. JH 08 H 0187, loaded with 50 cattle, has been seized by the police party and petitioner is owner and driver the said vehicle.
4. Learned counsel for the petitioner submits that no one has lodged complaint about theft of any cattle and as such, no offence is made under Sections 379 and 414 of the Indian Penal Code. Petitioner is owner of the commercial vehicle in question upon which he was only transporting the cattle and he

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sherghati in connection with Amas P. S. Case No. 216 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
