1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 74, 115(2), 117(2), 109, 351(2), 351(3), 352 and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy aged about 19 years and the informant alleges that he was working in the house of Vibhash on 09.06.2025, when a child came and informed that his wife is being assaulted, accordingly, he came to his house and saw the accused persons, thereafter Pintu assaulted him by khanti causing injury on head, while petitioner assaulted his wife by kudal on head causing injury, thereafter accused persons kept assaulting them, on alarm
Patna High Court CR. MISC. No.69926 of 2025(2) dt.14-10-2025 2/3 people gathered and accused fled and the injured were taken to PHC from where they were referred to Sadar Hospital, Munger.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the informant has not disclosed his relationship with the petitioner, it is submitted that petitioner is own nephew of the informant and are having dispute relating to property. It is further submitted that no doubt petitioner is alleged to have assaulted the wife of the informant by Kudal causing injury on head, but then the petitioner has been implicated only with a view to coerce his father, Pappu Chaudhary, into submission who is brother of the informant. It is next submitted that the date of occurrence is 09.06.2025 and the police recorded the fardbayan of the informant in the hospital on 11.06.2025 and thereafter on 15.06.2025 the FIR was instituted. It is also submitted that the injury suffered by the injured is simple in nature.
5. The learned counsel for the petitioner next submits that even presuming what has been alleged is true without admitting then to err is human and to forgive is divine and the petitioner is a young boy aged about 19 years and in the event if
Patna High Court CR. MISC. No.69926 of 2025(2) dt.14-10-2025 3/3 he is sent to judicial custody, his entire career would get jeopardized and chances are bright that he may come in contact with hardened criminals.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and taking into consideration the age of the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Haveli Kharagpur P.S. Case No. 134 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
8. Accordingly, the instant anticipatory bail application stands allowed.
