JUSTICE MADHURESH PRASAD ORAL ORDER 02-04-2018 The petitioner has filed the instant application for cancellation of bail allowed to opposite party no.1 Sarvan Kumar Chaudhary @ Sharwan Kumar Chaudhary in Biraul Police Station Case No. 274/2017 vide order dated 18.1.2018, passed in Cr.Misc.No. 3369/2018.

It is submitted by learned counsel for the petitioners that the poligraphic test of the opposite party no.1 is awaited by the court below. However, in view of the 2nd condition which mandates representation of opposite party no.1 on each date and the consequence of cancellation in case of default on two consecutive dates, after some arguments, learned counsel for the petitioners prays to withdraw the bail cancellation application. The instant application is permitted to be withdrawn. In case, the opposite party no.1 breaches the conditions of the bail order, the court below may take steps in terms of the conditions governing grant of bail to opposite party no.1. Shashi.
