Petitioner is accused in connection with Raiyam P.S. Case No. 34 of 2018 registered under Sections 376, 34 of the I.P.C. and 3/4 of the POCSO Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. The first information report is lodged after lapse of seven months. There is specific allegation against co-accused Mantun Chaupal. Nothing has been alleged against the petitioner in the statement of the victim recorded under section 164 Cr. P.C. Further submission is that in the medical examination, the age of the victim has been assessed by the Doctor between 18 to 19 years. It is also submitted that petitioner is in custody since

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Darbhanga in connection with Raiyam P.S. Case No. 34 of 2018.
