2. The petitioner apprehends arrest in connection with Dariyapur P.S. Case No. 349/2017 dated 30.12.2017, instituted under Section 392 of the Indian Penal Code.

3. The allegation against the petitioner is that he along with other accused persons on the point of pistol snatched his mobile having SIM of Reliance Company, driving license, PAN Card, Aadhar Card, Pen Drive including other articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

It is submitted that petitioner is not named in the F.I.R. and only on the basis of confessional statement of Dhanu Rai @ Deepak Rai and Raja Kumar, he has been implicated in this case. Nothing incriminating material has been recovered from the possession of the petitioner. It is submitted that petitioner has completed his graduation in English Hons. in 2017 and thereafter got engaged in competitive examination. Petitioner has no criminal antecedent.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Dariyapur P.S. Case No. 349/2017, subject to the conditions laid down in Section 438(2) of the C.r.P.C.

7. The application stands allowed.
