JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Hajipur Town P.S. Case No. 110 of 2017 instituted for the offence under Sections 114, 290, 370, 354, 509, 34 of the Indian Penal Code, Sections 3, 4, 5, 7 of Immoral Traffic Act, Sections 4, 6 and 8 of POCSO Act. It is alleged that on receiving secret information about flesh trade in S.K. Residential Hotel, the police reached there, from where, this petitioner along with one girl namely, Gudia Khatoon and other persons, as mentioned in the written report were found in compromising condition.

It has been submitted on behalf of the petitioner that the victim girl Gudia Khatoon has not levelled any allegation against the petitioner. It has further been submitted that co-

Patna High Court Cr.Misc. No.14654 of 2017 (3) dt.09-05-2017 2/2 accused Sonu Kumar, who also alleged to have been found in the Hotel, in compromising condition, has been granted bail by a coordinate Bench of this Court vide order dated 4.5.2017 passed in Cr. Misc. 17822 of 2017.

Case diary has been received.

Learned A.P.P. has submitted that statement of Gudia Khatoon has been made in paragraph-24 of the case diary wherein she has not levelled any allegation of specific overt act against the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge cum Spl. Judge, Vaishali, in connection with G.R. No. 653 of 2017/05 of 2017 arising out of Hajipur Town P.S. Case No. 110 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
