JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-10-2019 This application, for grant of anticipatory bail, arises out of Jamui P.S. Case No. 448 of 2019, disclosing offences under Sections 468/420 of the Indian Penal Code. Petitioner is a doctor and allegation against him is that he issued a false medical certificate, by which, one candidate has been shown to be of lesser age than her son. Submission of learned counsel for the petitioners is that he was also one of the members of medical board, who issued the certificate but only the petitioner has been made accused in this case. Further submission is that he is a Orthopedician and there was no Radiologist in the medical board. It has also been submitted that he is a Government servant and ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 448 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. Further condition is that petitioner will cooperate in the investigation and make himself available as and when required by the police.
