The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner assaulted the informant on his head with butt of pistol.
It is submitted that allegation of commission of assault with butt of pistol is false because on the alleged date of occurrence petitioner was in Kolkata and Durgapur Railway police detained him for travelling without ticket on 12.12.2021. When petitioner paid the fine he was released by the railway police and in support of the same annexed paper vide Annexure2. Moreover, the FIR was lodged after delay of six months
Patna High Court CR. MISC. No.72008 of 2022(2) dt.06-04-2023 2/2 without any plausible explanation. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 138 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
