The petitioner apprehends his arrest in Bikram P.S. Case No. 126 of 2016 instituted for the offence under Section (s) 302/120B of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted that petitioner has clean antecedent. There is no specific allegation against this petitioner of causing fire arm injury on the person of the deceased. As per written report, co-accused Ranjeet Yadav, Raju Yadav and Ajay Prasad Yadav are alleged to have fired on the person of the brother of the informant who later on died.

Patna High Court Cr.Misc. No.14467 of 2017 (2) dt.28-03-2017 2/2 Ajay Prasad Yadav has been granted regular bail by a coordinate Bench of this Court vide Cr. Misc. No. 49259 of 2016 on 09.02.2017.
From the written report, this Court finds that there is no allegation of any overt act against this petitioner. The petitioner is mainly alleged to be the member of the unlawful assembly.
From the order of the learned Sessions Judge also, this Court does not find any substitutive material against this petitioner.
In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Bikram P.S. Case No. 126 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
