Petitioner apprehends his arrest in Sheosagar P.S. Case No.97 of 2017 for the offences under Sections 341, 342, 323, 307, 379/34 of the I.P.C. and Section 27 of the Arms Act. Petitioner is named in the F.I.R. along with other coaccused persons but no specific allegation of firing is attributed against this petitioner.
Learned counsel for the petitioner submits that the accused persons against whom main allegation of firing has been made, have already been granted benefit of anticipatory bail and other accused against whom there is allegation of standing there along with other accused persons has already been granted anticipatory bail by coordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.12907 of 2018 (2) dt.03-04-2018 2/2 dated 18.10.2017 passed in Cr.Misc.No.49245 of 2017. Heard learned A.P.P. also and opposed the prayer for anticipatory bail of the petitioner.
Having heard both sides and in view of the facts and circumstances of the case and other similarly situated co-accused have already been granted anticipatory bail, prayer for anticipatory bail is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction A.C.J.M.-II, Sasaram, Rohtas, in Sheosagar P.S. Case No.97 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further conditions that his bailors must be of local having sufficient immovable property within the jurisdiction of the Court and the petitioner shall cooperate in the investigation.
