2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 324, 326 & 307 of the Indian Penal Code.

3. As per the prosecution case, while the informant was on patrolling, he received an information of firing near Dhanki Road. Thereafter, he reached on the spot and found some people fleeing away. On enquiry, he learnt that due to some dispute, firing took place between the group of Kumod Narayan Choudhary and the petitioner from one side and Awadhesh Yadav, Satrudhan Sahni and their associates on the other side, in which two persons sustained injuries.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. There is case and counter case. Grand mother of the petitioner also sustained injuries. Allegation of firing is general and omnibus against this petitioner and no specific overt act has been alleged against him.

5. Considering the fact that there is general and omnibus allegation of firing against the petitioner, prayer for

Patna High Court CR. MISC. No.71896 of 2023(2) dt.07-11-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Judge IV cum Additional Chief Judicial Magistrate IV, Patna City in Agamkuan Police Station Case No. 502 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
