The petitioner seeks bail in Kanti P.S. Case No. 575/2016, registered for the offences punishable under Sections 401, 420, 467, 468 of the Indian Penal Code.
The informant S.H.O. of Kanti P.S. alleged that while he was on patrolling duty he saw the petitioner fleeing away after parking a motorcycle. The petitioner was apprehended and he is said to have disclosed that he used to commit theft and robbery and thereafter he purchased motorcycle bearing registration no. BR06BC0520. The petitioner filed case bearing Kanti P.S. Case No. 566/2016 for theft of the aforesaid motorcycle only to get money from the Insurance Company.
Patna High Court Cr.Misc. No.14919 of 2017 (2) dt.20-04-2017 Learned counsel for the petitioner submits that in fact the petitioner lodged the case for theft of motorcycle and the police recovered the motorcycle. The police called the petitioner to hand over the motorcycle and demanded money and when the petitioner refused to grease the palm of the police, the police implicated the petitioner in this case making false allegation. The petitioner has got no criminal antecedent. The petitioner is in jail since 29.12.2016.
Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner has already remained in jail for about 04 months and he has got no criminal antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate West Muzaffarpur in connection with Kanti P.S.
