JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 366(A)/34 of the Indian Penal Code.

The statement of victim was recorded under Section 164 of the CrPC in which, she claimed that she was taken away by the petitioner and others but subsequently, she was released by the petitioner and his associates from their clutches and thereafter, she was taken by police. The victim has, nowhere, stated about the ill behavior meted out to her by the petitioner as well as his associates.
