====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-12-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Jhajha P.S. Case No.72 of 2024 instituted under Sections 302, 201, 498(A) and 34 of the Indian Penal Code.

3. As per the prosecution case, the marriage of the petitioner was solemnized 12 years ago as love marriage. The petitioner developed illicit relationship with another woman. The informant was informed by the petitioner that his sister-in-law had committed suicide. The petitioner along with his other family members have already performed the last rituals of dead body.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The marriage of the victim with the petitioner was solemnized 12

Patna High Court CR. MISC. No.73901 of 2024(3) dt.18-12-2024 2/2 years ago and they were residing peacefully together. Except the suspicion, there is no material against the petitioner and there is no eye-witness of the occurrence. He further submits that petitioner was never involved in the torture to the victim. The petitioner is in custody since 04.07.2024. Charge sheet has already been submitted in this case and he undertakes to cooperate in the trial.

5. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui/ concerned Court in connection with Jhajha P.S.
