The petitioner seeks bail in connection with Kumarkhand (Belari O.P.) P.S. Case No. 04 of 2019, registered for offence punishable under Section 395 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated on the basis of confessional statement of one Nilesh Kumar. Further submission is that nothing has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 28.07.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.65062 of 2019(2) dt.04-11-2019 2/2 and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Madhepura in connection with Kumarkhand (Belari O.P.)
