The petitioner seeks bail in connection with Kotwali P.S. Case No. 63 of 2016, registered under Sections 385 and 387 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner surfaced in the confessional statement of co-accused Manjeet, except the confessional statement nothing has been collected by the I.O of this case to show his involvement in the present case. Further submission is that, in fact, petitioner is accused in 33 cases, out of which in 17 cases, he has been acquitted as detailed in para-03 of the petition, due to that reasons, the Police got implicated the petitioner in the
Patna High Court Cr.Misc. No.15016 of 2017 (2) dt.13-04-2017 2/2 present case only on the basis of confessional statement of Manjeet and the petitioner is in custody since 02.12.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 63 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
