The petitioner has preferred this application for grant of regular bail in connection with Ara Muffsil P.S Case No. 136 of 2020 dated 05.05.2020 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the petitioner and the coaccused person along with 10-15 other persons armed with rifle, gun, lathi and iron rod assembled there after firing. On being object by the informant and his brother, the co-accused Bijendra Rai fired on the head of the informant's brother, Triloki Shankar Rai resulting his death and the co-accused Pappu Rai fired on

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is a member of mob. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 16.10.2020 passed in Cr. Misc. No. 23664 of 2020. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.04.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Ara Muffsil P.S Case No. 136 of 2020.

The application stands allowed.
