The petitioner apprehends his arrest in connection with Bairgania P. S. Case No. 64 of 2016 instituted under Sections 364, 366A and 372 of the Indian Penal Code.

The allegation, in brief, is that petitioner enticed away minor daughter of the informant for the purpose of marriage. Learned counsel for the petitioner submits that the girl, in her statement under Section 164 Cr.P.C., admits that she was in love relationship with the petitioner and has eloped voluntarily and got married.

Learned counsel for the informant submits that the girl is minor and is studying in Class-VI and as per her birth certificate she is only 14 years of age.

Patna High Court Cr.Misc. No.15218 of 2017 (2) dt.12-04-2017 2/2 Having considered the age of the girl, the prayer for anticipatory bail of the petitioner is rejected. However, if so advised, the petitioner may surrender and seek regular, which shall be considered on its own merit without being prejudiced by this order.
