ANJANA MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are in custody since 20.08.2019 in connection with Rajapakar P.S. Case No. 204/2019 registered for the offence punishable under Sections 30 (a)/32(2) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of these petitioners and the Swift car does not belong to the petitioners. The petitioner No. 1 has no criminal antecedent, save and except, one other case under the same Act in which he is on bail whereas petitioner No. 2 has no criminal antecedents. In view of the aforementioned facts and
