====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-02-2025 Heard Learned Counsel for the petitioner and Learned A.P.P. for the State.

2. Learned Counsel for the petitioner submits that bail application of the petitioner has earlier been rejected vide order dated 22.02.2023 passed in Cr. Misc. No. 62766 of 2022 and Trial Court was directed to expedite the trial and conclude it within six months. Counsel further submits that on previous occasion, report about the present stage of the trial has been called for and from the said report, it transpires that trial has not been concluded and three official witnesses are yet to be examined in this case and therefore, Trial Court has demanded six months to conclude the trial.

3. Learned A.P.P for the State opposes the prayer for bail and submits that three official witnesses are yet to be examined in this case.

4. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

5. It is directed to the Superintendent of Police, Vaishali at Hajipur to do all the needful for adducing the evidences of official witnesses in connection with Sessions Trial No.707 of 2022 arising out of Lalganj P.S. Case No.233 of 2021. He is directed to instruct the concerned S.H.O. and I.O to produce the official witnesses of this case before the Trial Court so that the trial may be concluded within three months from today, otherwise, the Superintendent of Police, Vaishali at Hajipur shall take suitable action against the concerned S.H.O. and I.O.

6. Registry is directed to transmit a copy of this order to the Superintendent of Police, Vaishali at Hajipur through fax, email or any other mode forthwith. Registry is further directed to hand over a copy of this order to Learned APP for the State who shall communicate this order to the Superintendent of Police, Vaishali at Hajipur at his level.
