JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Earlier prayer for bail of the petitioner was rejected twice by this Court firstly by order dated 1.11.2018 passed in Cr.Misc.No. 62053 of 2018 and secondly by order dated 6.3.2019 passed in Cr.Misc.No. 10924 of 2019. Petitioner is one of the assailants of the deceased.

Submission of learned counsel for the petitioner is that he is in custody for almost two years and there is no substantial progress in the trial.

Heard learned APP, who has opposed the prayer for bail on the ground that all the prosecution witnesses except official witnesses have been examined and the case is pending for evidence of I.O. and Doctor.

In such view of the matter, I am not inclined to grant bail to the petitioner.

No.75403 of 2019(3) dt.29-01-2020 2/2 However, learned trial court is directed to expedite the trial and at the same time Superintendent of Police, Rohtas and Civil Surgeon, Rohtas are directed to ensure the presence of the I.O. and the Doctor in the trial court on the date fixed, so that the trial may be concluded at the earliest.

This application is, accordingly, dismissed.
