The Petitioners seek bail in Fatehpur P.S. Case No. 30 of 2017 instituted for the offence under Section(s) 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
It is alleged in the written report that various people were apprehended by the police on confidential information and foreign liquor and country made liquor were recovered. Petitioner No. 1 was driver of the vehicle from which 33 litres of foreign liquor has been recovered, whereas from the vehicle which was driven by petitioner No. 3, 2172 pieces of 200
Patna High Court Cr.Misc. No.14590 of 2017 (2) dt.20-04-2017 2/2 ML country made liquor have been recovered. Petitioner No. 2 was found sitting in one of the vehicles.
It has been submitted by learned counsel for the petitioners that all the petitioners were arrested by the police on the same day and they are in custody since 29.01.2017. It has been mentioned in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Xth, Gaya in connection with Fatehpur P.S. Case No. 30 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioners.
