JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Complaint Case No. 1157 of 2016 instituted for the offence under sections 376 and 34 of the Indian Penal Code.
It has been submitted that petitioner is nephew of Murat Ram. There is no allegation of specific overt act against this petitioner.
As per complaint petition, the complainant married with Murat Ram and started living in Delhi. She lived in Delhi with Murat Ram for two months. Thereafter, he and other accused persons forced to her to establish physical relationship with other persons.
Patna High Court Cr.Misc. No.14562 of 2017 (2) dt.30-03-2017 2/2 The name of this petitioner has come in the complaint petition alongwith other accused persons. In this manner, there is no allegation of any specific overt act against this petitioner.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Complaint Case No.1157 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Kaimur at Bhabhua, subject to the conditions as laid down under Section 438(2) Cr.P.C.
